FRANCHISE
I have regularly represented Dunkin' Donuts Incorporated and Baskin-Robbins in matters throughout Ohio for at least the past 18 years. I have also represented other franchisors as well as franchisees and those purchasing a franchise. Here, more specifically, is what I do in the franchise area:
- Enforcment of existing franchise and lease agreements, by issuing notices to cure defaults, followed by terminations if cure is not made
- Filing and prosecuting civil actions in federal court under the Lanham Act for trademark, trade name and trade dress infringement following terminations.This includes obtaining restraining orders and injunctions.
- Negotiate settlements, to resolve existing disputes
- Review franchise agreements and related documents/disclosures preliminary to a client's purchase of a franchise
